Welcome to Raising Successful Sleepers, we provide services subject to the notices, terms and conditions as set out below. We reserve the right to change these terms or condition at any time. By accessing, browsing, or purchasing a service on this website, you agree to all the terms and conditions in this agreement. If you do not agree with these terms then please do not use this site or our services. 

 

Section 1: Online-Store Terms:

 

By agreeing to the terms and services of this website you are verifying that you are at least 18 years of age or older. 

You may not transmit any worms or viruses or any code of destructive nature to this site. 

You may not use our intellectual property for any illegal or unauthorized purposes, nor may you use these services to violate any laws in your jurisdiction (including but not limited to copywrite law)

 

Section 2: General Conditions: 

 

We reserve the right to refuse services to anyone at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and involve a) transmissions over various networks; and b) changed to conform and adapt to technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks.

You agree to not reproduce, duplicate, copy, sell, resell, or exploit any portion of service, use of the service, or access to the service or any contact on the website through which the service is provided, without express written permission by us. 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these terms.

Delivery:

 

All services purchased through Raising Successful Sleepers are delivered electronically to the email address provided by the purchaser or through phone services to the phone number provided by the purchaser. Raising Successful Sleepers is not responsible for ensuring that all materials are sent to the correct email address or that the phone number provided is correct. It is the responsibility of the purchaser to contact Raising Successful Sleepers through the website or by email ( Brittany@Raisingsuccessfulsleepers.com) to correct an email address or a phone number that was incorrectly provided. The Client has 30 days from the initial purchase to contact Raising Successful Sleepers with the correct information before voiding their right to a refund. 

 

Payment Terms: Billing Information Accuracy: 

We reserve the right to refuse any order placed with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing/shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by the email, billing address, and/or phone number provided on the order. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers, or distributors. 

 

You agree to provide current, complete, and accurate purchase and account information for all purchases made through Raising Successful Sleepers. You agree to update your information including email addresses, credit card numbers, and expiration dates, so that we may complete your transactions efficiently and contact you if needed. 

 

All payments are expected in full at the time of purchase unless otherwise noted.

Refund Policy:

 

Due to the nature of Services provided by Raising Successful Sleepers refunds are limited in scope to the following: 

 

1.   Withdraw from Services- A full refund will be administered to the purchaser if a change of mind occurs within the first (10) days of purchase and no services have already been rendered*. The 10 day grace period begins the day the contract is sent to the purchaser and ends 10 days from that date OR when the questionnaire is submitted to the sleep consultant.

2.   Sleep Consultant Cancelations- If the sleep consultant cancels a service or ends a contract early for reasons other than listed below a full or partial refund will be administered depending on the length of time remaining in the contract.

3.   Natural Disaster or Unexpected tragedy: Purchaser may be granted a full or partial refund in the event of a natural disaster or unexpected tragedy. Events that qualify for this refund are at the sole discretion of Raising Successful Sleepers. 

4. Medical Necessity- If after the questionnaire the purchaser is referred to a medical professional who states that sleep training is no longer a safe option indefinitely, then the purchaser will be partially refunded. Total charge- Administrative/ Questionnaire review = refund amount (an itemized list is available). Raising Successful Sleepers reserves the right to request a doctors note.

 A refund will not be administered for, but not limited to, the following reasons:

1.   Refusal to seek recommended medical services to ensure it is safe to continue sleep training. A full refund may be administered under the withdraw clause or Medical Necessity clause if terms apply.

2.   Purchaser decides to no longer use the services OR Does not respond to requests/ communication in a timely manner once they have started the process of sleep training* and/or the 10-day limit of withdraw has passed. The Purchaser is expected to return information, forms, schedule phone calls, and use support services in an efficient manner. Raising Successful Sleepers will still maintain the terms of the contract and be available for consult during the 30 day period. If the purchaser goes beyond those 30 days, Raising Successful Sleepers reserves the right to charge for the remainder of services.

3. The Purchaser does not abide by the terms of the contract.

4.   Services have been completed but purchaser is un-happy with the outcome. 

 

Raising Successful Sleepers does not guarantee anything when purchasing services. The nature of this service is to educate, encourage, and coach. It is up to the purchaser to implement these strategies and communicate efficiently with the sleep consultant. Since there is no way of knowing that all advice was followed in the correct way, no refunds will be administered once services are completed. 

*Services are considered to have been rendered/ started once the purchaser has submitted the questionnaire for sleep consultant review

 

Service Information:

 

1.  Eligibility: You must be 18 years or older in order to visit our website or make any purchases through the organization of Raising Successful Sleepers. By using our website you represent that you are 18 years or older and that you have the right, authority, and capacity to agree to and abide by these terms. You also represent that you will use these services and this website in accordance with any applicable laws and regulations.

 

While we strive for accuracy, Raising Successful Sleepers does not warrant that our product description and website content is accurate, free of errors, complete, or current. If any Service ordered from us is not as described as is shown on the website, a refund will be administered- as described in our return policy. 

There are certain days that Raising Successful Sleepers is fully closed-meaning we will not respond to any Emails, Text Messages, or any from of communication during these days. There are set dates in our calendar that we will not be open but the purchaser understands that other dates of closure may occur unannounced

The following are set holidays that Raising Successful Sleepers will be closed:

-New Years Day

-Easter Sunday

-Mother’s Day

-Father’s Day

-4th of July (both actual date and observed)

-Thanksgiving Day

-Christmas Eve

-Christmas Day

-New Years Eve

If your package includes one of these dates or a date of closure that occurs unannounced Raising Successful Sleepers will add the missed amount of days on to your personal package.

All Individualized service details are laid out in the contract to be signed by both parties before services begin.

 

 

Liability Limitations

 

We do not warrant that results obtained from the service will be accurate or reliable. 

 

We do not guarantee that your services will be uninterrupted, timely, secure, or error-free. 

You expressly agree that your use, or non use, of this service is at your sole risk. The service and all materials provided to you through Raising Successful Sleepers is for educational and informational purposes only and does not take the place of a medical or other professional provider. 

 

Raising Successful Sleepers Safe Sleep Practices are in line with current guidelines provided by the CDC, AAP, and WHO. All services rendered are done so based on the assumption that sleep training is being done in a safe environment as outlined by the organizations mentioned above. Raising Successful Sleepers holds no responsibility for the purchaser using un-safe sleep practices (as deemed by accredited organizations) and holds no liability in the outcome of those practices. While we strive to keep up to date with any and all safety regulations and suggestions by upstanding organizations, Raising Successful Sleepers’ information may not always be accurate or up to date. It is the responsibility of the purchaser (parent or caregiver) to be informed on all recommended safe sleep practices.  

 

 Raising Successful Sleepers is not a medical service nor do we administer any medical advice, however we may suggest that you speak with your medical provider or another professional based on information given to us at the time of contact. It is the responsibility of the purchaser to decide if they will seek our recommendations or not. 

We are not responsible for any outcome or expense related to referred providers. Raising Successful Sleepers holds no responsibility for the health, injury, death, damages, or expenses of any kind that may occur during or after our services. 

 

Raising Successful Sleepers retains the right, at our sole discretion, to temporarily suspend or end a service until recommended medical or professional services are met. Details of payments already rendered can be found in our Refund Policy. 

 

Raising Successful Sleepers takes no responsibility for the health or well-being of any clients. Any and all health information provided is taken at the word of the purchaser (parent or caregiver). We do not confirm any medical diagnosis or check with any medical providers to obtain confirmation to continue or start sleep training.

 

 

Dispute Clause:

 

We hope to work out any dispute of activity on the website or services rendered privately between party negations first. If however a solution to the dispute cannot be met within 30 days of initial complaint, the dispute will be submitted to confidential arbitration in Alabama, Auburn- Lee County, unless you have in some way threated or violated our intellectual property rights, whereby Raising Successful Sleepers may seek an injunctive. 

 

 

 

Intellectual Property:

 

All materials created by Raising Successful Sleepers is the intellectual property of the company. Materials rendered to clients are meant for personal use only and are no way to be replicated, reproduced, sold, or copied for the use of another person. 

 

All photos on are the intellectual property of the owner of Raising Successful Sleepers or are photos used with permission from upsplash through the website hosting service of Squarespace. They may not be copied, redistributed without expressed permission of the owning party. 

 

Review and Testimonial Policy:

By leaving a review on this website you are herby consisting and allowing Raising Successful Sleepers to distribute, redistribute, and disclose any and all information written in the review/testimonial. By leaving a review you understand that the review and all of its contents might be used for, but not limited to, advertising and promotions of the company.  By leaving a review/ testimonial you wave your right to any financial compensation for publications of any kind that include your review/testimonial. By leaving a review/testimonial you agree that you are voluntarily sharing your information and story. You agree that all aspects of the review/testimonial are true to your experience and reflect the services rendered. You understand that Raising Successful Sleepers has the right to dispute or clarify any claim you make in your review that may be false, defamatory, or includes foul language.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising or relating to your use of optional third-party tools. 

Any use by you of optional tools offered through the site is entirely at you own risk and discretion and you should ensure you are familiar with and approve the terms of use on which tools are provided. We may at some point offer new services or features on this website that will also be subject to these terms of use.
